Bereskin & Parr’s Winners of Impact Cases of the Year Awards by Managing IP Awards
Bereskin & Parr LLP is pleased to announce that we are a Winner of the Impact Cases of the Year Award for our work on Pentastar Transport Ltd v FCA US LLC. Our firm successfully represented FCA US LLC. In a decision at the end of 2019, the Supreme Court of Canada established the standard of review approach to be taken in appeals of all administrative decisions. Less than three months later, Justice Kane was the first, in a trademark opposition appeal, to apply the Supreme Court of Canada’s new approach, finding that the appellate standard, as opposed to the presumptive reasonableness standard, is to apply.
In addition, our firm has also been recognized as a Winner of the Impact Cases of the Year Award for our work on Miller Thomson v Hilton Worldwide Holding. B&P successfully represented Hilton Worldwide Holding LLP in an appeal to the Federal Court of Appeal of a Federal Court decision that had overturned a non-use cancellation proceeding decision. In a finding with broad implications on the question of whether services have been performed in Canada, Justice Mactavish found that where purchasers or members of public in Canada receive a material benefit from the activity in issue, it will amount to performance.
