Micheline’s practice focuses on assessing new technologies, preparing and prosecuting patent applications worldwide, and conducting due diligence analysis on patent portfolios. She has work experience in the chemistry, microbiology, immunology and molecular biology fields, and has worked in the industry for multi-national companies, government agencies and in a hospital laboratory.

Micheline stays at the forefront of the life sciences industry, and regularly contributes to various publications, and is a speaker on the issues that affect IP in the industry.

Impact of Recent Court Decisions on Claim Drafting Strategies of Life Science Inventions in Canada and the United States

Recent court decisions in the United States and Canada have impacted the scope of allowable claims for life science technologies such as diagnostic assays, therapeutic molecules and sequence (nucleotide, amino acid, peptide). The panel will present and discuss current claiming strategies for these technologies for prosecution in Canada and the United States in reference to commercial value from an industry perspective. A case study will be presented to illustrate the differences and similarities in the claiming strategies.
