Jennifer McKenzie is a partner with Bereskin & Parr LLP and Head of the Regulatory, Advertising & Marketing practice group.

Jennifer has extensive experience in trademark prosecution and enforcement, as well as, personality and publicity rights, regulatory, advertising and marketing law.

She is recognized as a leader in her profession and has been ranked in a number of directories, including the Canadian Legal Lexpert Directory, Who’s Who Legal: Trademarks, Chambers Canada Guide and Best Lawyers in Canada.

In addition to her extensive trademark practice, Jennifer reviews advertising and claim substantiation for clients in a wide-range of industry sectors from prepackaged consumer goods to regulated products such as drugs, cosmetics and food. Jennifer has represented clients in competitive trade disputes before Advertising Standards Canada, and provides advice to clients on federal and provincial privacy legislation for the private sector, including the drafting of consumer facing privacy policies and terms of use, and consumer protection legislation. Jennifer helps clients in relation to promotion and contest design.

Jennifer is a frequent speaker on intellectual property issues such as marketing, advertising, branding, labeling and privacy law. She has spoken for organizations such as the Intellectual Property Institute of Canada (IPIC) Intellectual Property Owners Association (IPO), and the Ontario Bar Association (OBA).

On Saturday, May 2, Scott MacKendrick will be on the North American panel at 11:15am as part of the “Course on International Trademark Law and Practice”. The course is designed to provide a comparative analysis of trademark law and practice in countries around the world. He will also be a moderating the table topic “Madrid Protocol, Nice Agreement, Singapore Treaty and Use: Major Changes to Canada's Trademark Regime” on Sunday, May 3 at noon.

Janice Bereskin will be speaking on Sunday, May 3 between 2pm and 3:15pm with other INTA leaders as part of the informative and interactive session "CSU50 INTA Committee Selection, Membership and Involvement: Behind the Curtain". The session will discuss the diverse and valuable benefits associated with active involvement in INTA.

Leadership Meeting 2014

Dan Bereskin, Cynthia Rowden, Susan Keri, Scott MacKendrick, Terry Edwards, Jonathan Colombo, Mark Robbins, Janice Bereskin, Francois Larose and Jonathan Burkinshaw will be attending the International Trademark Association’s (INTA) Leadership Meeting 2014.

Janice will be the co-chair for the Leadership Meeting, and the co-chair of the Presidential Task Force for INTA. She will be presenting to the Board of Directors on November 12th.

Scott will be speaking on “Teaching in the U.S. and Canada: Theories and Practicalities” on Friday, November 14th from 4:15 p.m. to 6:15 p.m. Speakers for this presentation will compare and contrast the U.S. and Canadian legal systems, their impact on teaching, and some of the practical aspects of being an adjunct professor.

The CLE credited event will cover a wide range of education sessions discussing advanced-level topics, including social media scams; misleading trademark use; privilege, privacy and data security; the effects of culture on trademarks; and improving partnerships between in-house and outside counsel.

INTA is a global association of trademark owners and professionals dedicated to supporting trademarks and related intellectual property in order to protect consumers and to promote fair and effective commerce.

Successfully represented Automatic Princess Holding, LLC, owned by Mariah Carey, as respondent in an application for judicial review of a decision of the Registrar of Trademarks refusing the applicant’s request for leave to amend the statement of opposition. The application for judicial review was refused, with costs awarded to the respondent. Appeal heard by the Federal Court of Appeal, decision pending.
