Bill S–17 came into force on Thursday July 12, 2001

Accordingly, a patent filed before October 1, 1989 whose 17 year term has not expired before July 12, 2001, will have a patent term that is the longer of either 17 years from the date of issue or 20 years from the date of filing. Bill S–17 implements changes to the Canadian Patent Act to bring Canada into compliance with the TRIPS Agreement, and particularly to extend the patent term for some of the patents filed before October 1, 1989.
