BILL C 11 RECEIVES ROYAL ASSENT
On December 13, 2002, Bill C-11, An Act to Amend the Copyright Act, received Royal Assent. The Bill, which amends Section 31 of the Act, clarifies who is eligible to obtain a compulsory licence to retransmit TV and radio signals by redefining the term "retransmitter" to exclude New Media companies who retransmit signals over the Internet and are currently exempt from CRTC regulation under The Broadcasting Act.
Now that the Bill has passed, the CRTC will prepare a report to clarify regulatory issues surrounding Internet retransmissions. Recommendations in the report should assist the government in further restructuring the compulsory licensing scheme as Bill C-11 gives the Governor-in-Council authority to make regulations imposing conditions on new types of retransmitters, who wish to become eligible for the compulsory licensing scheme.
