Profile

Justine Wiebe is a partner with Bereskin & Parr, and has an in-depth knowledge of trade mark law, and considerable experience in advising on the protection, enforcement and licensing of trade mark rights. Justine's area of expertise is non-traditional marks, and she has an established record in overcoming registrability objections for such marks. Justine is current on foreign trade mark law developments, including the implementation of the Madrid Protocol by the United States and the European Community, and is experienced in guiding international trade mark searching and filing strategies and managing international trade mark portfolios. Justine has advised on the intellectual property aspects of business transactions, and has assessed trade mark portfolios of clients and targeted acquisitions. Justine also has advised on advertising and marketing issues, including comparative advertising claims and bilingual requirements under the Quebec Charter of the French Language.

Justine writes and presents frequently on trade mark matters. Justine co-authored the chapter on trade marks in the “Intellectual Property Disputes” loose-leaf service published by Carswell. In 2006, Justine directed an intensive trade mark course titled “Understanding Trade Marks”, hosted by the Intellectual Property Institute of Canada (IPIC) and McGill University. In 2007, Justine’s presentations included “Effective Trade Mark Searching Strategies” presented at the IPIC Spring Meeting and “Applications for Special Marks, Examiners’ Reports & Responses, and Post-Advertisement Matters” presented at the IPIC/McGill course.

Justine has served on various IPIC, INTA (International Trademark Association) and IPO (Intellectual Property Owners Association) committees. Currently, she is an active member of the IPIC International Trade-mark Issues Committee and the IPO U.S. Trademark Law Committee and 2008 Annual Meeting Programs Committee. Also, Justine is working with the INTA Publications Committee as a principal editor on an international trade dress publication.
