Order a Trade Mark Search

At Bereskin & Parr, we know that it takes experience and a sound knowledge of the fundamentals of trade mark law to perform and advise regarding clearance searches that can be relied upon with confidence. As a leader in Canadian intellectual property law, we have the expertise to deal thoroughly and quickly with all issues pertaining to trade mark and trade name clearance and we offer a comprehensive range of searches to our clients, including the following types of clearance searches:

Full Registrability Search

A search of the Canadian Register of Trade Marks, corporate/company names, trading styles and common law sources including telephone and trade directories.

Register Search

A search of the Canadian Trade Marks Register which covers Canadian registered trade marks and pending applications to which serial numbers have been assigned. Marks which are in use in Canada and which are not the subject of trade mark applications will not be revealed in the search. A further search of company names, trading styles, telephone and trade directories is recommended in order to better assess the availability of the mark.

Preliminary Search

The objective of this type of search is to determine relatively quickly and inexpensively if the exact mark is on the Canadian Trade Mark Register database. The failure to locate a conflicting mark does not necessarily mean that the mark is available for use. More exhaustive searches are required to clear the mark for use.
